Kristina’s Tutoring Terms and Conditions

You agree to these Terms and Conditions when you hire us for Tutoring services.

TERMS AND CONDITIONS – TUTORING SERVICES

The following terms and conditions apply specifically for Tutoring Services. Do not hire us until you have read the following, the Disclaimer, and the Privacy Policy so you understand your obligations and also the Company’s obligations.

Kristina’s Tutoring provides tutoring services for students ages 5-18 years old.

  1. EFFECTIVE DATE: The “Effective Date” is the date you sign the Agreement. Kristina’s Tutoring will have no obligation to provide any Tutoring Services until you sign up for Services and pay the Fees due. YOUR CHILD’S SPOT WILL NOT BE RESERVED UNTIL WE RECEIVE THE FULL PAYMENT FOR THE MONTH YOU ARE RESERVING.

  2. FEES:

    • No Show Fee. If you miss a scheduled tutoring session then you will be charged the Fees you have already paid for that tutoring session and there will be no refund. There will be no make-up or rescheduled lessons.

    • Tutoring Services.  Tutoring Services must be paid by the 1st of the month for your child’s spot to be held. Invoices are sent out one week prior to the last day of the month for the upcoming month.  Late payments will be subject to a 10% fee. The late fee is added seven days after the invoice is sent. You will continue to be charged the Fees until you notify us in writing that your student will no longer be attending the tutoring sessions. The Fees paid are for holding the student’s place with a Tutor instead of offering that place to one of the many on the waiting list. Do not rely on your student to verbally tell his or her Tutor or any other individual that he or she will no longer be attending the tutoring sessions.

    • Prices are as follows:

      • $40.00 per lesson for K-12th grade Reading students. Lessons are 30 minutes

      • $40.00 per lesson for K-6th grade Math Students. Lessons are 30 minutes

      • $60.00 per lesson for 7th-12th grade Math Students. Lessons are one hour.

      • When more than one lesson is booked in a week the first lesson will be $40.00, the second lesson will be $37.50, the third lesson will be $36.50, and the  fourth lesson will be $ $35.00

  3. FOR CAUSE WITHDRAW OR TERMINATION: Company, at its discretion, may withdraw a student or terminate at any time without notice if Client:

    • Fails to pay its Fees.

    • Is inconsistent with the lessons

  4. VOLUNTARY PARTICIPATION: Client understands and confirms that participation with the Scope of Services is voluntary and that you can start, continue, or stop your participation at any time.

    • Expectation requirements of clients of Kristina’s Tutoring are as follows:

      • Arrive on time to the tutoring sessions;

      • Take notes;

      • Ask questions if there’s any confusion about the information provided;

      • Understand that Services end on time and will not go over time; and

      • Ensure that the space Client uses for each tutoring session is a quiet, confidential, and private space that is free from distractions.

  5. NO AGENCY: Client acknowledges and agrees that neither any Tutor, any teacher, or representative or other agent of the Tutor, or any Subcontractor (“Tutor”) is an agent of Client. No Tutor, representative or agent of the Tutor is authorized to waive or alter any term or condition of the Services Terms and no representation as to the Services or any other matter by the Tutor of any materials, supplies, and equipment, will in any way affect Client’s duty to pay fees and perform its other obligations as set forth the Services Terms.

  6. CONFIDENTIALITY: The parties understand and agree that in the performance of the Services Terms each party may have access to private or confidential information of the other party which either is marked as “confidential,” or the other party should reasonably know under the circumstances that such information is confidential and proprietary information of the other party.

    • Confidential Information. This private or confidential information includes, but is not limited to Client requirements, Client lists, financial information, marketing information, and information concerning employees, products, services, prices, sources, operations, operations, subsidiaries, and other protected and private information (“Confidential Information”). Neither party will divulge such Confidential Information without the express written consent of the other party.

    • Public Information is not Confidential. Confidential Information does not include information that is: (1) publicly known at the time of disclosure or subsequently becomes publicly known through no fault of the Receiving Party; (2) discovered or created by the Receiving Party before disclosure by Disclosing Party; (3) learned by the Receiving Party through legitimate means other than from the Disclosing Party or it’s representatives; or (4) is disclosed by Receiving Party with Disclosing Party’s prior written approval. If a party discovers that any Confidential Information has been used, disseminated, or accessed in violation of the Services Terms, that party will immediately notify the other party; take all commercially reasonable actions available to minimize the impact of the use, dissemination, or publication; and take all necessary steps to prevent any further breach of the Services Terms.

  7. NON-RECRUIT: Client and Company will not, during the Term and for a period of three (3) years immediately following termination of this Agreement, either directly or indirectly, recruit any of the other party’s “employees” for any purpose without written consent. This includes but is not limited to Company’s 1099 personnel, interns, independent contractors, or any person who has worked with Company for at least one year. Client acknowledges that by hiring a Company employee without prior written authorization, Client may be liable for damages that include but are not limited to lost income, profitability, training expenses and other damages to Company.

  8. YOUR RESPONSIBILITY: Company will not be responsible for injury to any person who sustains an injury because of your participation. You knowingly and voluntarily assume all risks of injury, harm, liability, loss, damage, or death in any way connected with participation with the Sites, Products, and Tutoring Services. You assume full responsibility for your actions that may cause harm to you, the Tutor or other third parties. In addition, if at any time, you believe that present conditions are unsafe or that you are unable to participate due to physical or medical conditions, then you will immediately discontinue your participation.

  9. THIRD-PARTY PAYMENT VENDOR: You understand and agree that the Payment Information is collected and processed by a “Third-party Payment Vendor” pursuant to the terms and conditions of the Third-party Payment Vendor’s privacy policies and terms of use. You agree that the Third-party Payment Vendor, and not the Company, is solely responsible for your Payment Information, and the Company will not be liable for any damages, claims or liabilities arising from the Payment Information.

  10. IF PAYMENT FAILS: In the case of a charge being declined or returned for insufficient funds (“Failed Payment”), you understand that the Company will notify you of the Failed Payment. You acknowledge that additional attempts will be made to process the payment. However, if the additional attempts continue to result in a Failed Payment, then you will have five (5) days from the Company’s notice of the Failed Payment to pay the amount due or the Company may refuse to provide the services.

  11. REFUND POLICY: For Tutoring Services, the Company has a “No Refund Policy.

  12. NO GUARANTEES: You acknowledge that the Company has made no promises or representations to you, nor has it given you any assurances as to the favorable or successful outcome of your participation with the Sites, Products such as Tutoring Services. Our opinions related to the Services are limited only to opinions based upon our experience and judgment. You acknowledge that such expressions should not be considered as representations, promises, or any guarantee of results. You understand that your success is further dependent on the amount of time and consistency you are willing and able to do.
